The subject of this User Agreement (hereinafter referred to as the Agreement) is the relationship between MAGNET MEDIA HOLDING LLC, which is the administrator (hereinafter referred to as the Administrator) of the sites autoua.net, dynamo.kiev.ua, gagadget.com, okino.ua, mama.ua, ringside24.com (formerly boxnews.com.ua), woman.ua, luxlux.net, udoktora.net, qp.ua, mabila.ua, torba.com, mabila.com, nashasvadba.ua (hereinafter referred to as the Site, Sites), and by you (hereinafter referred to as the User) regarding the use of the Sites.
The Administrator reserves the right, at its sole discretion, to change the Agreement at any time without special prior and / or subsequent notice to the User. The current version of the Agreement is available at https://magnet.kiev.ua/en/rules/. The User is solely responsible for checking for changes to the Agreement. The User’s continued use of the Site after any changes to the Agreement implies the User’s consent to such changes.
The User understands and agrees that the Administrator may, at his own discretion and without special notice to the User, change the set of materials and / or functionality of the Site.
The User understands and agrees that the Administrator is not responsible for the accuracy of the advertising information posted on the Site, and for the quality of the advertised goods/services.
Copyrights to the materials of the Site belong to the Administrator, unless otherwise indicated on the Site.
When using the materials of the Site in full or in part, an active link to the Site is required. The link must not be closed by the “nofollow” and “noindex” parameters. Violation of this provision of the Agreement may entail the responsibility of the User in accordance with the current legislation of Ukraine.
User
A user is any natural person who logs into the Site via the Internet. This Agreement becomes available to the User and enters into force for the User when the latter enters the Site. Further use of the Site is a confirmation of the User’s consent to the terms of this Agreement. The User’s use of the Site, any of its services and services, means the User’s unconditional consent to all clauses of this Agreement and the unconditional acceptance of its terms.
In order to use some of the individual functions of the Site, the User must complete the registration procedure, as a result of which a unique account will be created for the User.
The User’s personal information contained in the User’s account is stored and processed by the Administrator in accordance with the confidentiality provisions of this Agreement.
When registering, the User independently chooses a login and password for accessing the account. The administrator has the right to prohibit the use of certain logins, as well as set requirements for the login and password (length, allowed characters, etc.).
The user is responsible for and takes steps to ensure the security of his account (including the control of the e-mail address). The User is fully responsible for all actions performed using the User’s account. The User undertakes to immediately notify the Administrator of any cases of unauthorized use of the User’s account by third parties.
The User agrees to the use by the Administrator of the User’s personal data in order to ensure the operation of the Site, provide the User with access to the materials of the Site, as well as provide information services to the User. By entering the Site and / or registering on the Site, the User thereby allows the Administrator to collect, process, use and store the User’s personal data, and also confirms that he is familiar with the features of the use and protection of personal data established by the Law of Ukraine “On the Protection of Personal Data” and other current legislation of Ukraine.
The User agrees to receive messages from the Administrator to the e-mail address specified by the User during registration. The Administrator undertakes not to disclose information about the User to third parties without the consent of the User, except for the disclosure of information at the request of the court and / or law enforcement agencies and / or in other cases provided for by applicable law.
The user has the right to:
use the username and password chosen by him upon completion of the registration process of the User for authorization on the Site;
Create your own text messages, comments, product reviews, and share opinions about published information;
contact the Administrator at any time using the feedback form.
The user is prohibited from:
unauthorized (that is, without the consent of the copyright holder) use the resources and materials of the Site;
post materials and/or information of an advertising or commercial nature on the Site, except for sections of the Site specially designed for this purpose;
post illegal and/or dangerous materials and/or information on the Site;
post materials and/or information containing obscene language on the Site;
post materials and/or information on the Site, the content of which violates the current legislation of Ukraine and the provisions of international law;
to use the materials of the Site in whole or in part without linking to the Site.
The User understands and agrees that he is responsible under the current legislation of Ukraine for any information and / or materials that the User posts on the Site.
By posting information and/or materials on the Site, the User guarantees that he has all the necessary rights to post information and/or materials on the Site. If the User does not have the proper rights to post any information and/or materials on the Site, then the User undertakes not to post such information and/or materials and is responsible for the content, placement and use of such information and/or materials.
Administrator
The administrator has the right to:
block or delete a User account;
prohibit user access to the Site or to part of the Site’s capabilities by IP address;
delete any materials and/or information posted by the User without explanation;
move messages to other sections if, in the opinion of the Administrator, they relate to other topics;
use the email addresses left by the User on the Site to send messages.
The Administrator is not responsible for any consequences caused by the Visitor’s use of materials posted on other Internet sites referred to by the Site.
The Site Administration does not check and does not have the technical and actual ability to check all information and / or materials posted by the User on the Site for their compliance with the requirements of Ukrainian legislation and the provisions of this Agreement, since such a check will make it impossible for the Site to function. However, the Site Administration can do this at any time at its discretion in case of appropriate doubts, in particular as a result of complaints from the copyright holders of materials and / or information posted on the Site.
The Administrator does not guarantee error-free and uninterrupted operation of the Site and is not responsible for any harm or any losses caused to the User or third parties by technical failures of hardware or software on any side.
By using the services of the Site, the User confirms his agreement that he uses the Site at his own risk and peril “as is”, evaluates and bears all the risks associated with the use of information and / or materials posted on the Site, and the Site Administration, including its management, employees and agents, is not responsible for the content of the information and / or materials posted on the Site, for any damages and losses resulting from the use of information and / or materials posted on the Site.
The Site Administration, including its management, employees and agents, is not responsible for any unauthorized access or use of the Site servers and / or any information stored on them about the Site Users, as well as for any errors, viruses, etc. .d., which may be transferred to the Site by Users or third parties.
Privacy Statement
The Administrator and the User agree that personal information (login, password, e-mail address and other data necessary to create an account and identify the User) transferred by the User to the Administrator and stored in the User’s account is confidential, except for information that is public.
The Administrator may transfer the User’s confidential information to third parties only with the consent of the User or on the basis of the current legislation of Ukraine.
Any information other than that specified in clause 4.1. of this Agreement is not confidential.
If the User independently discloses the information specified in clause 4.1 of this Agreement to third parties, such information ceases to be confidential and the Administrator is not responsible for its preservation from the moment of the above disclosure.
The user can apply to delete the account and all user data (email address) except for the comments left by submitting an application through the user’s cabinet.
Final Provisions
This Agreement is governed by the current legislation of Ukraine.
By visiting any of the pages of the Site, the User automatically accepts the terms of this agreement.
The User understands and agrees that he is responsible for any violation of his obligations under this Agreement.
Headings to the sections of the Agreement are provided for convenience and are not legally binding.
The rules on consumer protection provided for by the legislation of Ukraine cannot be applied to the relationship between the User and the Administrator, since all services are provided to the User free of charge.
All disputes and disagreements that have arisen between the Administrator and the User are, if possible, resolved through negotiations. If it is impossible to resolve disputes and disagreements through negotiations, they are subject to consideration in the appropriate court at the location of the Site Administrator.
